Marriage/divorce

Marital agreement

A marital agreement is an agreement between spouses about the distribution of their property and assets, different from what the Norwegian Marriage Act have decided.

The Norwegian Marriage Act contains certain formal requirements for the marital agreement to be valid. Our office can assist with drawing up a marital agreement after the legal formal requirements.

If the marital agreement shall be protected against creditors it must be registered in the Register of Marriage Settlements.

The marital agreement can be concluded either as a pre-nuptial agreement or as a post-nuptial agreement.

Divorce

Usually the properties and assets are divided between the spouses. But very often the divorce settlement becomes complicated and the need for legal assistance is advisable before starting the settlement proceedings.

Cohabition agreement

When two people live together without being married, they are not protected by the same legislation as a married couple. We therefore highly recommend non-marital cohabitates to enter into an agreement to make provisions with respect to their financial relations.

Breakdown of non-marital cohabitation

Settlements during breakdown of non-marital cohabitations are not regulated by legislation in the same way as divorce. As a general rule, the parties acquire what they own.

The settlement after such break ups is often complicated and conflicted. It´s therefore recommended to seek legal assistance before agreeing on settlement.

Child custody

In case of divorce or break up it is important to agree in the custody proceedings. The children can live with one parent, and have the right to spend time with the other parent. It can be difficult to agree on how this should be organized. According to The Children Act, the child’s best interest shall be crucial in this decision.

When the parents cannot come to a custody agreement, we provide legal assistance in an effort to find a solution.

Child welfare services

The Child Welfare Services is obliged to ensure that children in Norway are cared for in an adequate manner. If the parents are unable to provide care and protection for their child, the Child Welfare Services is obliged to provide assistance so that the child receive proper care.

According to the Children Act, the Child Welfare Services may intervene with family life to ensure the best interests of the child. Such initiatives may be help within the home, family group conference, foster home or residential child care institutions. We recommend that the parents seek legal advice during this process.

Employment law

Our firm provides legal assistance in employment proceedings. The main focus will be to find the best solution for both the employee and the employer.

Many questions may arise in a conflict with an employer or employee. We can help find some answers in this situation:

  • – Is the discharge legal?
  • – Are the formal requirements of the Workplace Environment Act fulfilled?
  • – What does it mean to be made temporarily redundant?
  • – What is a fair redundancy payment?
Occupational injury

A personal injury sustained in or as a result of one´s employment, is an occupational injury. This may lead to a claim for compensation.

It is very important to report the injury to both the employers insurance company, as well as to NAV (the Norwegian Labour and Welfare Administration). We recommend you to seek legal counsel as soon as possible in such cases, so that all deadlines in this process are complied.

Personal injuries have to be reported to both insurance companies and NAV. We recommend you seek legal counsel as soon as possible in these cases, so that all deadlines in the process are complied.
